Arnab Goswami Case: Supreme Court orders release of Arnab Goswami on interim bail

New Delhi: The Supreme Court has ordered the release of Arnab Goswami, Editor-in-Chief of Republic TV, and other co-accused on interim bail. A division bench headed by Justice Chandrachud said that Arnab Goswami and two other accused should be released on interim bail on a bond of Rs 50,000. The Supreme Court has directed the Police Commissioner to ensure compliance with the order immediately. The Supreme Court held that the High Court’s refusal to seek interim bail was wrong. Hearing the interim bail plea, the Supreme Court had made strict remarks that if the state governments target individuals, they should know that there is a top court to protect the liberty of citizens. The court suggests the Maharashtra government ignore all this.

The Supreme Court says that our democracy is exceptionally resilient, the Maharashtra government should ignore all this (Arnab’s taunts on TV). Meanwhile, on behalf of the court Arnab Goswami, senior advocate Harish Salve has demanded the CBI investigate the matter. He said that if a person commits suicide in Maharashtra and blames the government, will the Chief Minister be arrested?

During the hearing, Justice Chandrachud said, ‘If we as a Constitutional Court do not protect personal liberty, then who will? … If a state intentionally targets a person, a strong message needs to be given. Our democracy is exceptionally flexible.

Arnab had challenged the Bombay High Court’s denial of bail in the Supreme Court. The Bombay High Court refused to grant interim bail to Arnab and two others in the case for allegedly abetting the interior designer Anvay Naik to the local court for relief.

During the debate on Arnab’s bail plea, Harish Salve said that the powers of the state were being misused, ignoring malice and facts. An FIR was registered in this case in May 2018. The powers are being misused to double check.

Please tell that Alibagh Police wants police custody of Arnab. Seeking this, the prosecution’s special public prosecutor P Gharat said Arnab’s arrest was necessary, as the letter written before Anvay’s suicide was his name. If the arrest was not necessary, the magistrates would not allow him to be questioned in judicial custody.

A bail application was filed in the Raigad Sessions Court on Tuesday afternoon by Arnab’s lawyers. In the application, Arnab has declared himself innocent and said that the entire investigation into the suicide for which he was arrested for abetment has already been done. Raigad police has submitted their A-Summary (Closure Report) in Raigad Chief Judicial Magistrate’s court in 2019 in this case. The bail application states that the applicant is willing to cooperate fully with the investigating agencies.

Arnab has admitted that there was a commercial agreement between Anvay’s company Kancard and his company ARG. Under this, some work was yet to be done by Kancard in his studio. Therefore ARG stopped payment of Rs 74,23,014 of Cancard. But the matter was between two companies.
