Punjab and Haryana High Court has given a big decision regarding the marriage of Muslim girls. The Court upheld several earlier judgments on Muslim marriage, stating that if a Muslim girl is under 18 years of age but on adolescence, Muslim girl can marry anyone.
According to the Times of India report, Justice Alka Sarin, while hearing a petition filed by a Muslim couple from Punjab, gave the verdict based on article-195 of the Muslim religious book
The High Court said that if a Muslim girl is a teenager, then she can marry anyone she wants. In the book cited by the court, it is said that lack of evidence, adolescence should be considered on completion of 15 years of age.
What is the matter related to Muslim weddings?
Actually, this case is related to a 36-year-old man from Punjab and a 17-year-old girl. Both fell in love. After this, on 21 January this year, both of them got married by Muslim custom. This was their first marriage, but their families were not happy with it.
Both have alleged that they were receiving threats. After this, he moved the court. It was argued on behalf of the petitioners that any Muslim boy or girl, if he is a teenager, can marry anyone on his own free will and family or relatives will not interfere.
After hearing the arguments, the court said that Momdan girl can walk according to Muslim personal law. The court said the petitioners have been given the right by the constitution and hence they cannot be denied their right only at the will of their family.
The court also directed the Mohali SSP to take adequate steps for the safety and independence of the petitioners.
