House Passes HALT Fentanyl Act with Bipartisan Support, Paving Way for Harsher Penalties

The Republican-dominated House passed legislation on Thursday that intends to make provisions for harsher punishments for fentanyl traffickers under the “HALT Fentanyl Act”. The legislation also received support from the Democratic Party, and now there is a high possibility of the legislation becoming law.

The HALT Fentanyl Act has received the approval of 98 Democrats, compared to 74 Democrats when a similar version of the bill was passed in the previous Congress.

In that instance, the bill was not put to a vote, with many Democrats expressing fears that it was heavily tilted towards law enforcement and could lead to mass detentions and arrests. The latest bill passed with a 312-108 vote, and there is a strong chance of it being enacted.

The fentanyl epidemic has reached gargantuan proportions, and controlling it has been a top priority in the Republican election campaign. The tariff war imposed by the Trump administration also has its roots in the fentanyl epidemic.

Since the invasion of Afghanistan by the U.S., opium production, which was widespread in the lawless hinterland of the country, was significantly reduced.

Consumers in the U.S. began to graduate to synthetic opioids like fentanyl, which is also used as an anaesthetic during surgery and is 100 times more powerful than heroin.

China is a major producer of fentanyl, and the drug is smuggled by drug traffickers through the porous Canada and Mexico borders into the U.S. The recent tariffs are another tactic employed by the Trump administration on Mexico and Canada to do more to stop the smuggling of fentanyl into the U.S.

Fentanyl has a devastating effect on the human body, and the hospitalization costs due to the fentanyl side effects run into billions of dollars. Deaths due to overdose are also rising and have become the highest in the past few years.

Hence, there is a growing willingness among Democrats to back the bill, especially after the crushing defeat in the presidential polls. Republicans have long accused the Biden administration of not doing enough to halt smuggling and the entry of illegal aliens into the U.S.

One of the steps being taken in the new act is to reclassify fentanyl as a Schedule I drug. At present, it comes under Schedule II drugs. Experts state that changing the status of fentanyl to a Schedule I drug based on its addictive and deadly qualities will enable state law enforcement to ask for stiffer penalties and prison sentences for drug smugglers.
