The SC bench headed by Chief Justice of India NV Ramana on Wednesday questioned the lawyer of the Uttar Pradesh government, “Why Ashish Mishra’s bail has not been canceled yet if the case’s appointed investigation team’s report had recommended revocation of bail”.
Ministry of Home Affairs Ajay Misha’s son Ashish Mishra is the main accused of the Lakhimpur Kheri case, which happened on October 03, last year. He’s accused of crushing 8 protesting farmers of “Kisan Andolan” with his SUV and was arrested on October 09.
After this, Ashish was granted bail by the Lucknow bench of the Allahabad High Court in February. Ashish Mishra’s lawyers submitted two bail bonds of ₹3 lakh each in connection with his bail orders on February 14.
According to India Today, In court, the petitioners’ lawyer Dushyant Dave targeting the State government said, “His father (Ajay Mishra) is very influential.”
While, The CJI NV Ramana said, “The SIT had written to the Chief Secretary (Home) recommending cancellation of the bail. The monitoring judge also said this in his letter.”
This, the lawyer of the government said, “I have no idea about this. Me or standing counsel, no one has seen it.’
After that, he went out of the courtroom and contacted the Chief Secretary of the State. He then informed the court that the office of the chief secretary had not any recommendation letter from the SIT or the monitoring judge.
