What does Per Curiam mean? TikTok Ban Looms as Supreme Court Upholds Law Mandating ByteDance to Sell U.S. Assets by January 19

The clock for an impending ban on TikTok is ticking, and on January 17th, the ban seems even more possible with the US Supreme Court ruling that the law enabling the ban on TikTok is legal.

TikTok’s Chinese parent company, ByteDance, has been given January 19th as a deadline to sell its assets to a US company.

After this date, it will be illegal for companies in the US to enable services that distribute, maintain, or update the social media platform TikTok.

In an unsigned per curiam decision, the court stated:

“There is no doubt that, for more than 170 million Americans, TikTok offers a distinctive and expansive outlet for expression, means of engagement, and source of community. But Congress has determined that divestiture is necessary to address its well-supported national security concerns regarding TikTok’s data collection practices and relationship with a foreign adversary…”

What is Per Curiam?

For the unversed, per curiam is the Latin equivalent of ‘by the court,’ and the ruling has been delivered by a full court or a panel of judges after hearing the case, rather than being limited to a single judge.

The entire court makes an anonymous decision compared to the normal process when the judgment is delivered under a specific judge’s name.

Occasionally, a presiding judge delivers the decision on behalf of the court, and this is also referred to as per curiam.

In normal circumstances, presiding judges sign one or more viewpoints, which is the usual process in the majority of the court’s rulings.

However, if the names of the judges who share the same viewpoints in a judgment are listed, it is not considered per curiam.

Per curiam rulings are used in cases that the court considers mostly uncontroversial. They are brief and address the issues immediately, and are employed in rundown decisions in present-day practice, where the court renders a ruling without a full briefing or argument.

The court order has concluded that the challenged provisions do not violate the petitioners’ First Amendment rights.

The D.C. Court of Appeals also negated TikTok’s attempt to postpone the prohibition, which will take effect on January 19th, as per the per curiam ruling on December 13, 2024.

The law, signed by President Joe Biden on April 24, 2024, prohibits distributing, maintaining, or updating a foreign-owned entity in the US.

There has not been any reaction from representatives of TikTok.
