AAP MP Sanjay Singh gets relief from Supreme Court

The Supreme Court on Tuesday provided protection against any kind of punitive action against Aam Aadmi Party (AAP) leader and Rajya Sabha MP Sanjay Singh in the cases of alleged hate speeches recorded in Uttar Pradesh.

The Supreme Court said that the Uttar Pradesh Police is not being prevented from taking approval from the Chairman of the Rajya Sabha to take action against the MP in these cases.

The court has sought a reply from the Uttar Pradesh government on Sanjay Singh two petitions, requesting the simultaneous and cancellation of several FIRs lodged in the alleged hate speech statement. These primaries were recorded after a press conference organized by Singh on August 12 last year. Singh had alleged that the state government was favoring a particular section of the society.

During a hearing by a bench of Justice Ashok Bhushan and Justice RS Reddy, Singh’s counsel said that he cannot divide the society on the basis of caste and religion. Advocates Vivek Tankha and Sumir Sodhi, appearing for Singh, said the police did not follow the procedures while registering the case and action was not taken to take action against the Rajya Sabha MP.

To this, the bench said that it would not consider the sanctioning aspect at this stage, but that does not mean that no offense has been leveled against Singh. Significantly, on February 2, the Supreme Court refused to provide security to Sanjay Singh from a non-bailable warrant issued on an FIR registered in Lucknow.
