The Supreme Court has overturned the NCLAT order under which Cyrus Mistry was reinstated as chairman in Tata Sons.

The bench, headed by Chief Justice SA Bobde, has delivered the verdict, which also includes Justices AS Bopanna and Justice V Subramaniam. On 17 December last year, the Bench reserved the judgment in this case.

Tata Sons had filed an appeal against this decision of the National Company Law Appellate Tribunal (NCLAT) in 2019.

Shapoorji Pallonji (SP) group had also filed a cross appeal against this order of NCLAT, saying that it failed to give some necessary relief to Mistry. An appeal was made on behalf of the group that mistry firms should be entitled to representation in all the committees constituted by the board of directors of Tata Sons.

The SP Group had told the Supreme Court on 17 December that the removal of Mistry from the post of Chairman of Tata Sons was an attack by ‘bloody games’ and ‘ambush’ in the board meeting held in October 2016, it was based on the principles of company operations. Was against

At the same time, the Tata group denied these allegations, saying that there was nothing wrong in this and the board, using its authority, had removed Mistry from the post.
