Minor's rape: HC denies default bail to suspended Delhi Govt official, wife

The Delhi High Court denied default bail to accused Premoday Khakha for allegedly raping a 16-year-old girl and his wife for providing abortion pills in the case. Justice Jyoti Singh upheld the trial court’s decision, citing substantial investigation before the charge sheet was filed.

Khakha had challenged the trial court’s denial of statutory bail, claiming incomplete investigation. The court noted that the charge sheet was filed on October 11, 2023, and cognisance was taken on November 8, 2023, with substantial investigation completed. The couple is currently in judicial custody.

The 51-year-old Khakha, a suspended Delhi Government officer, was arrested in August 2023 after questioning, following the victim’s statement. The couple allegedly raped the victim multiple times between 2020 and 2021. Sections of the POCSO Act and IPC were invoked against them, with Khakha also facing criminal conspiracy charges for involving his wife in the crime.

The police source revealed that when the victim became pregnant, the accused threatened her and his wife provided abortion pills instead of assisting the victim. The case highlights the heinous nature of the crime and the shocking lack of compassion shown towards the victim. The accused’s attempt to secure bail was rejected, ensuring that justice prevails in the case.
