Allahabad High Court dismisses plea challenging suspension of lecturer who married twice

The Allahabad High Court has dismissed a plea by the UP government challenging the order of a single judge bench regarding the suspension of a lecturer for remarrying without annulling the first marriage. The division bench emphasized on the need for informing the employee about the allegations and providing an opportunity to explain.

In a recent verdict, Justice Ashwani Kumar Mishra and Justice Syed Qamar Hasan Rizvi stated that the state government must follow due process before imposing minor penalties on employees. The court highlighted the importance of informing the employee about the charges against them and giving them a chance to respond within a reasonable time frame.

The bench further ruled that once minor punishment is considered, the suspension of the employee is not permissible. It pointed out the lack of proper enquiry and opportunity for the lecturer to provide his side of the story before the action was taken.
