Could Donald Trump’s Red-Soled Sneakers Spark a Lawsuit?

Republican Presidential candidate and former U.S. President Donald Trump has been mired in a number of lawsuits, and in one such case, he has been fined by a New York Judge for $355 million in a civil fraud case.

However, Donald Trump seemed unfazed and recently introduced a new line of signature sneakers at Sneaker Con at the Philadelphia Convention Center on February 17, 2024.

Donald Trump had revealed a new sneaker line with the slogan “Never Surrender High-Top” boldly emblazoned.

However, there are rumblings that the shoes could become a subject of another lawsuit.

The bone of contention this time is the red sole of the former US president’s new shoes.

Another major shoe manufacturer, Louboutin, manufactures the famous top-line designer of women’s shoes, and it features a red sole.

Louboutin has been involved in many litigations in many parts of the globe, including the European Union.

The court in India has said the red sole is a trademark of this shoe designer.

Therefore, there is a high possibility that it will also take the “Never Surrender High-Top” sneakers just released by Donald Trump to the court.

The “Never Surrender High-Top” sneakers were a limited edition release and had a price tag of $399.

As per the gettrumpsneakers.com e-commerce site, the sneakers have already sold out, and the buyers will get them at the start of the month of July 2024.

A thousand pairs of sneakers had been released along with a perfume and a less costly version of the sneakers as well.

The sneakers which have red hues soles are the signature of another well-established brand Christian Louboutin.

The latter offers almost exclusively the red-hued soles in many of its brands, and many times has not shirked from suing other manufacturers like Yves Saint Laurent for infringing its signature red-hued soles.

Louboutin has pointed out that a registration has been issued to it by the U.S. Patent and Trademark Office in 2008 for its red sole for use on “women’s high fashion designer footwear.”

It could be argued that the “Never Surrender High-Top” sneakers cannot be categorized as “women’s high fashion designer footwear,” for which Louboutin has been issued a patent.

The latter can argue that it also created an array of sneakers for men and the patent is applicable to it as well.
